1. General Provisions 

Schroders Korea Limited is committed to protecting the privacy of data subjects (“Customers” or “You”) pursuant to Article 30 of the Personal Information Protection Act and Article 27-2 of the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. This Privacy Policy (“Policy”) sets out how we handle personal information you have entrusted to us.   

This Policy is subject to change from time to time in line with amendments to applicable laws, government regulations or the Company’s internal policies. Any change in the Policy will be disclosed through our web site. 

2. Items Collected, Collection Methods and Purposes 

※ Schroders Korea Limited is not involved in direct sales or sales to individual customers. For this reason, we do not collect or store personal information of individual customers under any circumstances.    

※ Our web site does not require a sign up process, nor is it used to hold any customer or gifting events. Our web site, therefore, does not collect or store any type of personal information of customers, such as name, address, email or telephone number.       

1) The items of personal information we collect and the purposes of collection are as follows:   

① When the information is needed to enter into distribution service contracts with distributors of collective investment schemes and undertake those contracts

A. Items collected  

- Information of the employee of the distributor (name, company name, department, company address, telephone number, email)

B. Purpose  

- To undertake any business related to the distribution service of collective investment schemes  

② When the information is needed to enter into investment advisory or discretionary investment management service contracts and undertake those contracts  

A. Items collected

- Information of the employee of the discretionary service customer (name, company name, department, title, company address, telephone number, email) 

B. Purpose 

- To enter into discretionary investment management service contracts and undertake related tasks    

 

③ When the information is needed to undertake other investment management tasks related to discretionary accounts and collective investment schemes  

A. Items collected

- Information of the employee of the investment trader/broker or corporate investor (name, company name, department, title, company address, telephone number, email) 

B. Purpose

- To undertake order-related tasks and provide information requested by the corporate investor    

2) We collect the information above using the following method:  

Documents, including contracts that contain the information on the employee of the collective investment scheme distributor, investment trader/broker or corporate investor, or direct provision of information by the customer   

3) We only use the personal information obtained from you within the intended scope described above. However, we may use the information beyond the intended scope in the following exceptional cases: 

① Where we obtain your consent;   

② Where there exist special provisions in applicable laws;   

③ Where it is deemed obviously necessary for physical safety and property interests of a customer or a third person when the customer or his/her legal representative cannot give prior consent because he/she is unable to express his/her intention or by reason of his/her unidentified address, etc.;   

④ Where personal information is needed for compiling statistics or scientific research purposes, etc., and the personal information is provided in a form by which a specific individual cannot be identified 

 

3. Processing/Retention Period of Personal Information   

We destroy relevant personal information immediately after we achieve the purposes of collecting and using such information.   

 

4. Method and Procedure of the Destruction of Personal Information   

In principle, we destroy relevant personal information immediately after we achieve the purposes of collecting and using such information using the following methods:  

1) Personal information printed on paper is shredded or incinerated 

2) Electronic files containing personal information are permanently deleted using a technical method that makes the files irrecoverable  

 

5. Provision of Personal Information to Third Parties  

1) We cannot provide your personal information to third parties other than those delegated by us to process such information. However, we may share your personal information with third parties within the intended scope in the following cases:  

① Where there exist special provisions in applicable laws or it is inevitable in order to comply with statutory obligations; 

② Where it is deemed obviously necessary for physical safety and property interests of a customer or a third person when the customer or his/her legal representative cannot give prior consent because he/she is unable to express his/her intention or by reason of his/her unidentified address, etc.

2) When we obtain your consent pursuant to paragraph 1) above, we must inform you of the following information. When we change any of the following, we must also inform you of the same and obtain your consent:   

① A recipient of personal information;   

② Purposes for which a recipient of personal information uses such information;  

③ Items of personal information provided;  

④ Period for which a recipient of personal information retains and uses such information; 

⑤ The fact that you have the right to refuse consent and details of disadvantages, if any, you may face due to your refusal  

3) We may provide third parties with your personal information beyond the intended scopes described in paragraphs 1) and 2) above in the following cases: 

① Where we obtain your consent;

② Where there exist special provisions in applicable laws;

③ Where it is deemed obviously necessary for physical safety and property interests of a customer or a third person when the customer or his/her legal representative cannot give prior consent because he/she is unable to express his/her intention or by reason of his/her unidentified address, etc.;

④ Where personal information is needed for compiling statistics or scientific research purposes, etc., and the personal information is provided in a form by which a specific individual cannot be identified

 

6. Entrustment of Personal Information Processing 

In principle, we do not entrust the processing of your personal information to others without your consent.   

 

7. Your Rights and Obligations and How You can Exercise Your Rights   

1) Access to personal information  

① You can make a request to access your personal information managed by us.   

② Upon receiving the request, we must enable you to access your personal information within 10 days. When there is a legitimate reason not to allow you to access the information, we must inform you of such a reason and delay your access. When such a reason becomes no longer valid, we must immediately allow you to access the information.    .

③ In any of the following cases, we may restrict or reject your access to your personal information after informing you of its reason:  

A. Where access to information is prohibited or restricted by law; 

B. Where it is apprehended that any third person’s life and body may be harmed, or any third person’s property and other interests may be unduly infringed on 

2) Correction or deletion of personal information  

① You may request us to correct or delete your personal information. However, if the collection of the information is required by other laws, you cannot make such a request.   

② Upon receiving a request from you to correct or delete your personal information, we must take necessary measures without delay, such as correcting or deleting the given information, and inform you of the result.  

③ When we delete any personal information, we must make sure that the deleted information cannot be recovered or reproduced.   

④ Where necessary, we may require you to submit evidence necessary for verifying your request for correction or deletion. 

3) Suspension of personal information processing  

① You may request us to suspend the processing of your personal information.  

② Upon receiving the request, we must suspend the processing of the information, completely or partially, without delay. However, we may reject such a request in the following cases:  

A. Where there exist special provisions in applicable laws, or it is inevitable in order to comply with statutory obligations;  

B. Where it is apprehended that any third person’s life and body may be harmed, or any third person’s property and other interests may be unduly infringed on;

C. Where it becomes difficult for us to undertake a contract if we do not process your information, such as a failure to provide you with agreed services, and you have not explicitly expressed your intention to terminate the contract   

③ In regard to personal information whose processing has been suspended at your request, we must take necessary measures, such as the destruction of the information, without delay.   

 

8. Measures to Ensure Safety of Personal Information   

We take administrative, technical and physical measures required for safeguarding personal information in order to prevent losses, thefts, leaks, forgeries or damages of the information.   

1) Internal management plans to ensure safe treatment of personal information; 

2) Control of access to personal information or restrictions on access rights; 

3) Application of encryption technology or equivalent measures for secure storage and transmission of personal information;  

4) Keeping access records to respond to personal information infringement accidents or taking other measures to prevent forgeries or alterations of personal information;  

5) Installation or renewal of security programs in regard to personal information;  

6) Physical measures, such as the installation of facilities or locking devices for safe storage of personal information        

9. Handling Complaints concerning Personal Information   

We have personal information handler and personal information controller to protect your personal information and handle complaints related to such issues.
